A proposed Settlement has been reached in a class action lawsuit alleging that borrowers were improperly charged fees when making payments on a Westlake account through ACI Payments, Inc. The proposed Settlement requires Westlake to establish a Settlement Fund of $1,200,000. Westlake’s records have identified Class Members who may be entitled to a Settlement Payment.

Submit a Claim Form and Receive a Settlement Payment | If you wish to make a claim and receive a Settlement Payment, you must complete a Claim Form online. You will receive your Settlement Payment from the Net Settlement Fund via the payment method you validly select on the Claim Form. You may elect to receive your payment via paper check or electronically via PayPal, Venmo, or Zelle, etc. If you would like to receive payment via Westlake Account Credit, please print a paper claim form and mail it to the Settlement Administrator. If there are amounts remaining in the Net Settlement Fund after the primary distribution, the Settlement Administrator will distribute the remaining amount per capita on a per account basis in a secondary distribution to Settlement Class Members who have completed a valid Claim Form, if economically feasible. If the Court approves the Settlement and it becomes final and effective, and you remain in the Settlement Class (i.e., you do nothing and do not otherwise exclude yourself from the Settlement), you will only receive a Settlement Payment if you submitted a Claim Form before the deadline. The Settlement Fund, after payment of Administrative Costs, any Court-approved Attorney’s Fees and Expenses, and Incentive Award, will be distributed per capita on a per account basis to those Class Members who submitted a timely Claim Form.
